Terms of Service

Acceptance of Terms

By using the services of Buildwell Maywood Landscaping, you agree to these Terms of Service. These terms apply to all services we provide, including lawn care, landscape design and installation, hardscaping, irrigation, tree care, and all other landscaping services. If you do not agree with any part of these terms, please do not use our services.

Services and Scheduling

We provide landscaping services as described in your service agreement or proposal. Service schedules are determined based on weather conditions, crew availability, and project requirements. We make every effort to maintain consistent schedules, but reserve the right to adjust timing when necessary due to weather, equipment issues, or other circumstances beyond our control.

For recurring maintenance services, you may cancel or modify your service schedule by providing at least 48 hours notice. Cancellations made with less than 48 hours notice may be subject to a cancellation fee. For installation projects, scheduling changes must be discussed and agreed upon by both parties in writing.

Payment Terms

Payment is due as specified in your service agreement. For one-time services and installations, payment is typically due upon completion unless other arrangements have been made in advance. For recurring maintenance services, payment is due on the schedule outlined in your agreement, typically monthly.

We accept payment by cash, check, or credit card. Late payments may be subject to additional fees as permitted by law. If payment is not received within 30 days of the due date, we reserve the right to suspend services until the account is brought current.

For larger installation projects, we may require a deposit before beginning work. The deposit amount and payment schedule will be clearly outlined in your project proposal. Any changes to the project scope that affect pricing will be discussed and approved before additional work is performed.

Property Access and Preparation

You are responsible for providing clear access to all areas where services will be performed. This includes unlocking gates, moving vehicles or obstacles, and ensuring our crew can safely access your property. If we arrive and cannot access the work area, you may be charged a trip fee.

Please secure or remove any valuable items, decorations, or fragile objects from work areas before our arrival. While we take care to protect your property, we cannot be responsible for damage to items that were not disclosed or visible to our crew. Please inform us of any underground utilities, irrigation lines, pet containment systems, or other hidden features before work begins.

Warranties and Guarantees

We stand behind the quality of our work. Installation services come with a warranty as specified in your project agreement. This typically covers workmanship and proper installation but does not cover damage from acts of nature, improper maintenance, or misuse.

For plant materials, we offer a limited warranty period as outlined in your agreement. Plants require proper care and watering to survive, and our warranty does not cover plants that die due to lack of water, extreme weather, disease, or pest damage beyond our control.

To maintain warranty coverage, you must follow any care instructions we provide and contact us promptly if issues arise. Warranty claims must be made in writing and will be evaluated on a case-by-case basis.

Liability and Insurance

Buildwell Maywood Landscaping carries liability insurance and workers' compensation coverage to protect both our employees and your property. In the unlikely event of damage caused by our negligence, we will work with you to resolve the issue fairly and promptly.

Our liability is limited to the direct cost of repair or replacement of damaged items, up to the amount paid for the services rendered. We are not liable for indirect, consequential, or incidental damages. Some situations, such as damage from hidden utility lines or pre-existing property conditions, may not be covered.

Weather and Delays

Weather conditions in California can affect landscaping work. We may need to reschedule or delay services during rain, extreme heat, or other hazardous conditions. This is for the safety of our crew and to ensure quality work. We are not liable for delays caused by weather or other circumstances beyond our control.

Termination

Either party may terminate ongoing maintenance services by providing written notice at least 30 days in advance. Any prepaid services will be honored or refunded on a prorated basis. For installation projects already in progress, termination terms will be handled according to the specific project agreement.

We reserve the right to terminate services immediately if payment is not received, if access to the property is denied, or if there are safety concerns for our crew.

Dispute Resolution

If any disputes arise regarding our services, we encourage you to contact us directly so we can work toward a fair resolution. Most issues can be resolved through open communication. If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action.

Changes to Terms

We may update these Terms of Service from time to time. Any changes will be posted on our website and will take effect immediately. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
